Wrongful Death Family Loss Claim
Life is so valuable that a wrongful death claim could never replace the treasure of someone’s life, legacy and memory. Having life lost to someone who was simply careless or negligent just doesn’t seem fair. Having another person intentionally or purposely take someone’s life is even more disturbing. Under Georgia law, survivors can claim compensation for expenses, loss, damages and costs for that loss of life. An attorney legally pursues a claim for compensation for financial recovery of losing the deceased. It is a claim or lawsuit against the liable party to provide for monetary loss of the deceased and their survivors.
Wrongful Death Attorney, Nick Schnyder for Roswell investigates, compiles and calculates a claim for the survivors and another claim for the personal representative of the estate of the deceased, as required by Georgia law. The spouse would be the first surviving family member to file a claim with a lawyer, but if there was no spouse, the children are eligible to file a claim. In the event there is no spouse and no surviving children, the parents of the deceased would be eligible to file. The total amount of the deceased family member’s future income and earnings would be realized, along with loss of companionship. Then the decedent’s personal representative of his estate would present a claim for expenses for medical and health care costs, including laying the person to rest, along with the calculated value of suffering and pain endured.
1st Claim by Surviving Family Members
Spouse is the first eligible to file claim to share with the children of the decedent. Children are the second if there is no surviving spouse. Thirdly, if no spouse or no children, parents of the deceased are eligible to file. Claim is for future income and earning potential had the deceased lived, in addition to loss of companionship.
2nd Claim by Personal Representative of Estate
Claim for compensation of medical costs and expenses, funeral and burial costs, in addition to the value of suffering and pain by the deceased.

Time Limit for Claim or Lawsuit
The Statute of Limitations in Georgia has a requirement for filing wrongful death claims and lawsuits. There is a two year time limit with which to file a claim. It starts from the date of death. The opportunity is lost if not within that two year frame. There can be as little as a six to twelve month time frame for government, city, county, state claim or lawsuit. Be sure to acquire lawyer legal counsel well before the time limit runs out to file a lawsuit so you don't go beyond the allotted time.
Types of Wrongful Death
The different types of reasons a Wrongful Death Attorney may file a claim from family survivors can vary, but have one thing in common which was the result of the fatality of a person. It was a wrongful fatality and happens to the best of Roswell families who need to pursue justice in the death of a family member. Negligence can be due to someone not taking thoughtful steps to avoid harming another. It can be carelessness. It can be a mistake or an error from personal injury harm where a party didn't take appropriate steps to alleviate an issue and in doing so, caused fatality. The decedent's life was wrongly taken due to the actions of another person, company or agency. Whether the deceased lost their life from another's mistake, careless action or complete negligence in keeping another from harm, they can be held responsible for the loss of life. In the case of someone who was a criminal and acted illegally and recklessly to cause a death, the guilty party can be noted as liable for the fatality. Someone may have assaulted another and caused their death, which wasn't by mistake, but was intentional. Murder is also intentional and not an act of mistake. A criminal may have caused loss of life through an illegal act and, in doing so, harmed another to the point of death. Whatever ended in death from the actions of another could bring on a wrongful death claim pursued by a lawyer, including causes from:
Vehicle accident due to the actions of an at fault driver
Medical error by a doctor who caused a patient sickness and death
Prescription drug that caused a person illness and fatality
Assault on a person that ended their life
Murder that was intentional and deliberate
Criminal action that harmed and killed another while committing an unlawful act

Pedestrian and Bicycle – Any time there are people walking or riding bikes near roads, in parking lots or on sidewalks, there is potential for a crash or accident that may end in death. This is more common in a large inner city where there are people on foot walking near traffic. A pedestrian or bicycle rider can lose their life or even cause a driver's loss of life in certain circumstances.
Work-Related Injury - Any type of company or business that has employees or workers can be injured or harmed while on the job or have a fatal accident where the employer was negligent in keeping them safe and free from harm. Construction and labor trades are prone to being injured on the job with more strenuous and physical work required of them.

Nursing Home Abuse – The aging population who are in nursing care homes in Roswell and throughout Georgia who rely on others to help them can become victim to harsh treatment or even death due to negligent employees. Medical Malpractice - Doctors, surgeons, specialists and nurses all play a major role in our health care in keeping us safe from sickness and death. Unfortunately, there are times when doctors or nurses or any health care professional can be negligent and cause the fatality of a patient under their care.
Unlawful Behavior – Unlawful and illegal actions where a person is aggressively thoughtless and reckless causing the death of another, whether by accident or by intentional murder of a victim. The criminal prosecution does not bring an automatic claim against the guilty. Wrongful death is a civil lawsuit brought on by the family, separate from criminal charge proceedings.

Wrongful Death Attorney Intervention
Intervention from a skillful wrongful death attorney for family legal support is critical in seeking and pursuing the full and maximum amount of allowable claim compensation from the negligent party. Knowing your rights in the state of Georgia is important for you and your family. Without knowledge of your rights, you will settle for anything an insurer would tell you. Always seek a lawyer for any serious injury or death because there is too much at stake to walk away with a minimal settlement when you missed out on claiming all that you were allowed under Georgia law. That’s why an attorney is so important. Insurance companies are out to provide the least amount in settlements as possible. Without having legal representation on your side, you are at the mercy of an insurance adjuster who isn’t on your side.

Every one has their own time period of working their way through the sorrow of loss and should be allowed to mourn to work through those feelings.
